The Lack of Candor

Why, why do some choose not to be honest with what is currently going on? Why, why be disrespectful and lash out, when confronted with the TRUTH? Why is the go to complaint that (insert the City Carrier Advocate’s Name) is always being “difficult” or “disrespectful” when all the advocate is doing is following the National Agreement that was signed by both NALC and USPS. While I don’t remember word for word, but I am pretty sure that back in 2022, when I took the oath as steward part of that oath was not to allow harm to come to the City Letter Carrier. If it wasn’t in the oath, we are surely told every steward class, and most if not all monthly meetings to file when management violates the National Agreement.

We also have a duty to settle issues at the lowest level possible, which management clearly refuses to do as my recent discipline demonstrates. Not to get side tracked, one management type says another management type was wrong, but the management type in question still even with full knowledge of being wrong refused to rescind said discipline. Then the management type has the gall to complain that I am being difficult, when management types do not hold their management type underlings accountable for their actions against the City Letter Carriers throughout Fresno.

M-01517 clearly states that all grievances settlements are binding, but in a recent Article 25 & 41 violation it took around 2 months, and other filings for the management type to honor the PS Form 8190 that was signed by a management type and steward. Management types like to complain the advocates of craft employees are being difficult, but in truth the management types are lacking extreme candor when anything is brought up. You have several management types blatantly either violating M-00012(below), or knowingly allow their management type underlings to refuse to cooperate with an official USPS investigation as allowed by the National Agreement, which is also a violation of ELM 665.11 and 665.3, which should be filed under Article 19, in addition to the Article 15 for violating M-00012.

M-00111(above) is very clear that management types can not use the processes as outlined in the M-39(1838-C) to harass carriers, while performing their duties as outlined in our handbook the M-41. If you feel management types are violating M-00111 ask for steward time, or if your zone/station doesn’t have a steward call the branch and ask for a steward to be assigned to your possible grievance. From what I am hearing some management types temporally assigned at Hughes are giving instructions to carriers while conducting 1838-C, this may be a grievance, ask for steward time so this can be filed immediately.

At Hughes we now have a settlement regarding PM office times, if you are being harassed at any station for your PM offices times request steward time, or call the branch and have a steward assigned to investigate if your station/zone doesn’t have a steward. Remember the M-41 is clear, that as soon as you have completed unloading your vehicle before dropping of out going mail, that is when you should move to office time and complete your PM office duties. What I would like to see is for Fresno to get a DRT decision, much like the DRT decision where management can not contact you on your personal cell phone once you request them not to in writing.

There are still flagrant violations of Article 8 and 41 happening throughout Fresno. Remember even during the exclusionary period we currently are in, the 11.5 + lunch rule still apply to everyone one including CCAs, the only ones the hour restrictions do not apply to is ODL. If management is violating Article 8 and/or 41 ask for steward time, or contact the branch, so a steward can be assigned. ODL are guaranteed 12 hours if anyone works off their assignment, management types have carriers come in on their NSD, if an 8 hour carrier is forced to work past 8 hours without maximizing all ODL of the zone up to 12 hours which would be 8:30pm, and having maximized all Fresno installations CCAs. If CCA’s are doing clerk work or are carrying rural route(s), and you as an 8 hour carrier is forced by management to work past 8 hours, that is a violation of the National Agreement.

If you suspect something is a violation of the National Agreement you do not have to explain anything to management, no matter how much they insist. If the management type’s violation has to do with hours it probably falls under an Article 8, if the management type’s violation has to do with holidays it’s an Article 11, if the management type’s are being abusive it’s an Article 19, CCA’s not getting their uniforms is an Article 26, carriers working off assignment is an Article 41 and 8, working off the clock is an Article 41. Just to give a few idea’s. Article 19 covers just about everything, so if you aren’t sure just say Article 19. You can always call the branch ask if it’s a violation, and they will tell you what Article to request steward time under. At the end of the day all you have to say is which Article number, do not explain anything else to management. If management asks you any questions about your steward time request, invoke your Weingarten Rights for the apparent PDI management seems to be conducting on your requested steward time request.

I recently have been hearing rumors about management types forcing carriers/CCAs to fill out a PS Form 1260 when they work past a certain time. For example let’s say you work until 1825, management types are making carriers/CCAs fill out a PS Form 1260 with an ET time of 1800. Do not do this, always clock out using the MDD, if you have previously followed management’s instructions to falsify your ET time, please contact the NALC Branch 231 immediately leaving a message and a way to be contacted. Either daily or weekly check your virtual timecard on liteblue and take a screenshot of it as proof.
