Heat Exhaustion/Stroke, You, and Fed OSHA

“Article 14 Safety And Health
Section 1. Responsibilities“
“It is the responsibility of management to provide safe working conditions in all present and future installations and to develop a safe working force.”

The above is the first sentence in Article 14. Management types like to ignore this, and tries to place to blame of everything on the carriers. If you feel something is unsafe, please make sure you document it on the form PS Form 1767. Yes, management will respond with something like “Not the proper use of the form” or some other BS. Make sure you get copies of the white copy as that is the only one legible, since the carrier receives the last page(Blue) which shockingly management never writes hard enough to go through 4 copies.

Once you have your copy of all the responses from the SCS and MCS, please make a copy, and provide the copy to NALC Branch 231 safety person Paul Shafer. Also, ask for steward time Article 14, and give a copy of the PS Form 1767 to the steward, so that an Article 14 can be filed for management’s contract violation.

As always if you believe you’re suffering from Heat Exhaustion/Stroke call 911 immediately, do not let yourself die like Brother Eugene Gates of Texas NALC Branch 132.

Apparently……..in Fresno there seems to be some confusion amongst the management types as to what is the proper use of PS Form 3996. PS Form 3996 is the only form that controls your time above 8 hours that is needed. Once you request PS Form 3996 management must provide it. Management has 2 options approve time or disapprove time. Either way it doesn’t matter what they decide as Article 3 allows management to manage or mismanage how they see fit.

As early as possible, before reaching your approved time please notify management that you will not make your approved PS Form 3996 time, and need further instructions as what to do with the mail. Once you are within a reasonable time ie within 20-30 minutes of your approved PS Form 3996 time, head back to the station, and ask the PM supervisor for instructions. The PM supervisor will either authorize you to return delivering the mail, or let you know to bring it to them, and to go home after you finish your PM duties.

Here in Fresno, management types seem to like to complain that some stewards are being “difficult”. To this I say we are the least “difficult” bunch around, if you treat the City Letter Carrier humanely.
